Return Policy

Conditions Of The Returned Goods

• Laundered or used goods cannot be returned;
• Goods must not be intentionally or accidentally damaged;
• Goods must be returned in their original packaging, with original labels, ornaments and accessories;
• Goods must be package properly, in the same way they were received;
• Custom goods are inelegible for exchange or refund, unless there is a manufacturer’s defect or error;
• Goods must be returned within 14 days staring from the day the Consumer excercised the right of withdrawal.

Examination of the goods:
RIVOLTA CARMIGNANI SPA reserves the right to request photografic evidence before allowing returns for defective products and taking charge of the shipping charges for the return of the goods to its headquarter.

Return Process/ Right Of Withdrawal

The Customer has the right to withdraw from the contract within 14 days.
The right of withdrawal expires after 14 days from the day on the which the Consumer or a third party, other than the Seller and indicated by the Consumer, acquires physical possesion of the goods.
To exercise the right of withdrawal, the Consumer has to notify RIVOLTA CARMIGNANI SPA of his intention to withdrawal from the purchase agreement, by an explicit statement ( letter sent by post, fax or e-mail).

To this end, you may use the Return Form. .

Non-conformity of the goods

If the returned goods do not comply with the specification stated on “Conditions fo the returned goods” RIVOLTA CARMIGNANI SPA will inform the Consumer, who may then choose to have the goods returned, as his own expense.
If the Consumer rejects the return of the goods, RIVOLTA CARMIGNANI SPA reserves the right to hold the goods and the amount corresponding to the purchase price of the goods.

Value of the returned goods

In accordance with section.57, paragraph (2), of the Consumer Code, the Consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. RIVOLTA CARMIGNANI SPA reserves the right to reject the return of any products that are damaged, dirty, deteriorated or are in a state which suggests that they have been used for purposes other than those mentioned above.
RIVOLTA CARMIGNANI SPA reserves the right to request compensation for any damage that may be attributable to the wilful or negligent conduct of the Consumer adopted when returning the goods.
RIVOLTA CARMIGNANI SPA shall not be liable for loss or theft of the returned goods, not attributable to it, as well as for return to an incorrect address or delays in the delivery of the goods.
It is therefore understood that Consumer bears full liability for risks related to delivery.
RIVOLTA CARMIGNANI SPA reserves the right to refuse returns that have not been properly authorized or sent not in accordance with the return policy of RIVOLTA CARMIGNANI SPA.
For all aspects not specifically expressed, the European legislation for distance selling trade shall be used.

Exclusion Of The Right Of Withdrawal

No right of withdrawal exists in case of agreement for:

• The supply of tailor-made or personalized goods;
• The supply of sealed goods which were opened after delivery and are not suitable for return due to hygienic and health protection reasons.

Timing

RIVOLTA CARMIGNANI SPA undertakes to refund the price as soon as possible and in any case not before having received the goods and having verified the compliance of the conditions of return.
Shipping charges for the return of goods will be refunded providing that the goods are defective.

Refund

RIVOLTA CARMIGNANI SPA will refund using the same method of payment used by the Consumer for the initial transaction, unless otherwise agreed with the Consumer.
In case of partial return RIVOLTA CARMIGNANI SPA will not refund shipping charges.
Refund will be issued in the same currency as the original purchase.
Any differences in amounts due to exchange rate fluctuations cannot be refunded.

Return Of The Goods

The Consumer undertakes to returns the goods within 14 days from the notification of withdrawal to the following address:

All costs related to the return of goods, excepting for those declared defective, are entirely charges by the Consumer.
